1. Agreement to Terms

By accessing or using HVAC Planned Maintenance ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

HVAC Planned Maintenance is a field service management platform designed to help HVAC companies manage their clients, equipment, maintenance agreements, and field technicians. The Service includes web and mobile applications.

3. User Accounts

Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Use a strong, unique password
  • Enable multi-factor authentication when available
  • Notify us immediately of any unauthorized access
  • Not share your account with others

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Upload malicious code or content
  • Impersonate any person or entity
  • Collect user information without consent
  • Use the Service to send spam or unsolicited communications

5. User Content

Ownership

You retain ownership of all content you submit to the Service ("User Content"), including client information, equipment records, and service data.

License

By submitting User Content, you grant us a limited license to store, process, and display such content solely for the purpose of providing the Service to you.

Responsibility

You are solely responsible for your User Content and ensuring it does not violate any third-party rights or applicable laws.

6. Subscription and Payment

Fees

Some features of the Service may require a paid subscription. Fees are described on our pricing page and are subject to change with notice.

Billing

Subscriptions are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees incurred.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial billing periods.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by HVAC Planned Maintenance and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. Third-Party Services

The Service may integrate with third-party services (such as mapping services). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HVAC PLANNED MAINTENANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless HVAC Planned Maintenance and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, providing additional notice. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HVAC Planned Maintenance is established, without regard to conflict of law principles.
